Many foundational models are hosted primarily in US data centres. Even if your CRM is hosted in Frankfurt or Dublin, the API call to the AI engine often represents a data transfer outside the EEA.

You must conduct a Transfer Impact Assessment (TIA) for these specific workflows. This assessment evaluates whether the laws in the recipient country impact the protection level guaranteed by the GDPR. For most marketing use cases, the risk is manageable, provided standard contractual clauses (SCCs) are in place and supplemental measures are applied.

Regional hosting is becoming more accessible. By 2026, it is projected that all major LLM providers will offer strictly regionalised processing where both the prompt and the completion never leave EU infrastructure. Until then, you must configure your enterprise settings to prefer EU regions where available.
